By creating an account, making a purchase, or accessing any content on MC2 Estimating, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Description of Services

MC2 Estimating provides professional estimating tools for construction contractors, including but not limited to:

• Downloadable templates, calculators, and checklists
• Proposal and documentation templates
• MC2 Pro access with all tools and updates
• Reference guides and documentation
• Enterprise licensing packages

3. User Accounts

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
• Not share your account credentials with others

4. Payment and Billing

4.1 Pricing

All prices are in USD and subject to change. We reserve the right to modify pricing with 30 days notice to existing customers. Price changes do not affect active subscriptions until renewal.

4.2 Payment Processing

Payments are processed securely through Gumroad. By making a purchase, you agree to Gumroad's terms of service and authorize us to charge your payment method.

4.3 Subscriptions (MC2 Pro Access)

MC2 Pro access is billed monthly at $197/month. Subscriptions automatically renew unless canceled. You can cancel anytime - cancellation takes effect at the end of the current billing period.

4.4 Refund Policy

• Digital Products: 30-day money-back guarantee. Request a refund within 30 days of purchase for any reason.
• MC2 Pro Access: Cancel anytime. If you cancel within 14 days of initial signup, we'll refund the current month.
• Enterprise Licensing: Custom refund terms in enterprise agreement.

5. Intellectual Property Rights

5.1 Our Content

All content on MC2 Estimating - including templates, guides, calculators, text, graphics, logos, and software - is owned by MC2 Estimating and protected by copyright, trademark, and other intellectual property laws.

5.2 License to Use

When you purchase a product, you receive a limited, non-exclusive, non-transferable license to:

• Download and use templates in your own business operations
• Customize templates with your company information
• Print materials for your own reference

5.3 Restrictions

You may NOT:

• Share, distribute, or resell our products or content
• Copy or reproduce templates for distribution to others
• Modify, create derivative works, or reverse engineer our content
• Remove copyright notices or watermarks
• Use our content to create competing products or services
• Share your login credentials with others

6. User-Generated Content

If you submit comments, reviews, questions, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with our services.

7. Prohibited Uses

You agree not to use our services to:

• Violate any laws or regulations
• Infringe on intellectual property rights

• The accuracy, completeness, or reliability of content
• That defects will be corrected
• Specific results from using our tools or templates

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MC2 ESTIMATING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims related to our services shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless MC2 Estimating from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We may also update product content, add new features, or remove outdated content without notice.
